Terms and Conditions

These Terms and Conditions (“Terms”) govern your use of the CharterIndia platform (“Platform”, “we”, “us”, “our”), operated by Powerman Advisory Services (“Company”), to search for, request, and book private aircraft charter services from third-party aircraft operators (“Operators”) listed on the Platform. By using the Platform, submitting a charter request, or making a booking, you (“Customer”, “you”) agree to be bound by these Terms.

1. Nature of the Platform

  1. CharterIndia is a marketplace and booking facilitation platform. We connect Customers with independent, third-party aircraft Operators. We are not an air carrier, operator, or owner of any aircraft listed on the Platform.
  2. Any flight booked through the Platform is operated solely by the Operator named in your booking confirmation, under that Operator’s own Air Operator Certificate (AOC) and regulatory approvals. CharterIndia does not operate, crew, maintain, or control any aircraft.
  3. CharterIndia’s role is limited to: presenting Operator listings, facilitating communication and price comparison, processing booking requests, and (where applicable) facilitating payment collection on behalf of Operators.

2. Eligibility and Account

  1. You must be at least 18 years of age and legally capable of entering into a binding contract to use the Platform.
  2. You are responsible for the accuracy of information provided during signup, booking, and payment, including passenger details required for security and regulatory compliance.
  3. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

3. Booking Process

  1. A booking request submitted through the Platform (via search and direct listing booking, or via the “Request a Charter” form) does not constitute a confirmed flight until the relevant Operator has accepted the request and full payment (where required) has been received.
  2. Prices displayed on the Platform are indicative and subject to confirmation by the Operator. Final pricing may vary based on aircraft availability, fuel surcharges, routing changes, applicable taxes (including GST), and add-on services selected.
  3. CharterIndia reserves the right to cancel or decline any booking request at its discretion, including where an Operator is unable to fulfil the request, where payment cannot be verified, or where the request appears fraudulent or in breach of these Terms.

4. Payments

  1. All payments for confirmed bookings must be made through the payment methods made available on the Platform. CharterIndia may use third-party payment processors to facilitate transactions; your payment information is subject to that processor’s terms and privacy policy in addition to ours.
  2. GST and other applicable taxes will be charged in accordance with applicable Indian tax law and as displayed at the time of booking.
  3. All amounts paid through the Platform are processed on behalf of the relevant Operator. CharterIndia may retain a service or facilitation fee as disclosed at the time of booking.

5. Cancellations and Refunds

  1. Cancellation terms (including any applicable cancellation fees and refund timelines) will be specified at the time of booking and may vary by Operator, aircraft type, and how far in advance the cancellation is made.
  2. In the absence of Operator-specific terms, the following default policy applies: cancellations made more than 72 hours before scheduled departure are eligible for a refund less any payment processing fees; cancellations made within 72 hours of departure may not be eligible for a refund.
  3. Refunds, where applicable, will be processed within a reasonable period (typically 7–14 business days) to the original payment method.
  4. CharterIndia is not responsible for cancellations, delays, or schedule changes caused by the Operator, weather, air traffic control, technical issues with the aircraft, or other factors outside CharterIndia’s control. In such cases, you should pursue any applicable remedy directly with the Operator, who remains responsible for the flight.

6. Operator Responsibility and Compliance

  1. All Operators listed on the Platform are independent third parties responsible for their own regulatory compliance, including holding a valid DGCA-issued Air Operator Certificate (AOC), aircraft airworthiness certification, crew licensing, and insurance.
  2. While CharterIndia takes reasonable steps to verify that listed Operators hold the documentation they represent, CharterIndia does not independently audit ongoing compliance and makes no warranty as to the airworthiness of any aircraft or the competence of any crew. You are encouraged to verify Operator credentials directly where you have concerns.
  3. The contract for carriage of passengers is between you and the Operator. CharterIndia is not a party to that contract and assumes no liability for the performance of the flight.

7. Limitation of Liability

  1. To the maximum extent permitted by applicable law, CharterIndia’s liability to you arising out of or in connection with your use of the Platform is limited to the facilitation fee (if any) retained by CharterIndia on the relevant booking.
  2. CharterIndia is not liable for any indirect, incidental, special, or consequential damages, including loss of profits, loss of business, or personal injury arising from the performance (or non-performance) of any flight by an Operator.
  3. Nothing in these Terms limits liability for death or personal injury caused by gross negligence or wilful misconduct on the part of CharterIndia, to the extent such limitation is not permitted by applicable law.

8. Special Categories of Travel

  1. Where a booking is made for religious or pilgrimage purposes and a concessional GST rate is claimed, you confirm that the information provided in support of that claim is accurate. CharterIndia and the Operator reserve the right to apply the standard GST rate and recover any shortfall where the concessional basis is found to be incorrect.
  2. Bookings involving medical evacuation, cargo, or other specialised use cases may be subject to additional terms communicated separately by the Operator.

9. Privacy and Data Use

  1. Information you provide (including contact details, travel details, and payment information) will be shared with the relevant Operator as necessary to fulfil your booking, and processed in accordance with our Privacy Policy.
  2. CharterIndia will not sell your personal data to third parties for marketing purposes without your consent.

10. Force Majeure

CharterIndia and Operators shall not be liable for failure to perform any obligation under these Terms where such failure results from circumstances beyond reasonable control, including but not limited to severe weather, natural disasters, air traffic control restrictions, government action, strikes, or other events of force majeure.

11. Changes to These Terms

CharterIndia may update these Terms from time to time. Continued use of the Platform after such changes constitutes acceptance of the revised Terms. Material changes will be notified through the Platform where reasonably practicable.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts at New Delhi.
