Terms and Conditions

These Terms and Conditions (“Terms”) govern the participation of aircraft operators (“Operator”, “you”, “your”) on the CharterIndia platform (“Platform”), operated by Powerman Advisory Services (“Company”, “we”, “us”, “CharterIndia”). By registering as an Operator, listing aircraft, or accepting a booking through the Platform, you agree to be bound by these Terms.
1. Nature of the Platform and Relationship
- CharterIndia is a marketplace that connects Operators with Customers seeking private charter services. CharterIndia is not a party to the contract of carriage between you and any Customer, and does not operate, own, lease, crew, or maintain any aircraft.
- Nothing in these Terms creates an employment, agency, partnership, or joint venture relationship between CharterIndia and the Operator. The Operator acts as an independent contractor at all times.
- Acceptance of a booking through the Platform constitutes a direct contractual obligation between the Operator and the Customer for the carriage in question. The Operator is solely responsible for the safe and lawful performance of that flight.
2. Eligibility and Registration
- To register as an Operator, you must hold a valid Air Operator Certificate (AOC) or equivalent authorisation issued by the Directorate General of Civil Aviation (DGCA) or other applicable regulatory authority, and must maintain such authorisation in good standing throughout your participation on the Platform.
- You warrant that all aircraft listed on the Platform are airworthy, properly registered, adequately insured, and operated in compliance with all applicable aviation laws, rules, and regulations, including but not limited to the Aircraft Act 1934, Aircraft Rules 1937, and applicable DGCA Civil Aviation Requirements (CARs).
- You warrant that all flight crew assigned to bookings made through the Platform hold valid and current licences, medical certificates, and type ratings appropriate to the aircraft being operated.
- CharterIndia may request documentary evidence of the above (AOC, insurance certificates, aircraft registration, crew licensing) at the time of registration and periodically thereafter, and may suspend or remove any listing or account where such evidence is not provided or where validity lapses.
- CharterIndia reserves sole discretion to approve, reject, suspend, or remove any Operator registration or listing, including where DGCA compliance cannot be verified or where past performance on the Platform raises reasonable concern.
3. Listings and Pricing
- You are solely responsible for the accuracy of all information in your listings, including aircraft type, seating capacity, base pricing, availability, and any add-on services offered.
- Prices listed on the Platform must be all-inclusive of your charges save for applicable government taxes (including GST), which will be calculated and displayed separately in accordance with applicable law.
- You may update pricing and availability at any time prior to a booking being confirmed by a Customer. Once a booking request has been accepted by you, the agreed price is binding save as otherwise provided in these Terms or agreed in writing with the Customer.
4. Accepting and Fulfilling Bookings
- On receiving a booking request through the Platform, you must respond (accept, decline, or request modification) within the response window specified on the Platform (currently 48 hours), failing which the request may be automatically released back to the Customer or to other Operators.
- Once you accept a booking, you are obligated to perform the flight as confirmed, subject only to: (a) circumstances of force majeure (see Section 9); (b) genuine and documented technical or airworthiness grounding of the aircraft; or (c) safety-related operational decisions made in your capacity as the responsible Operator under applicable aviation regulations.
- Where you are unable to fulfil a confirmed booking for any reason, you must notify CharterIndia and the Customer at the earliest opportunity, and must use reasonable efforts to arrange a substitute aircraft of comparable type and capacity at no additional cost to the Customer, where reasonably possible.
- Cancellations by you without a valid reason under Section 4.2, particularly cancellations made close to the scheduled departure, may result in penalties as set out in Section 7, and repeated cancellations may result in suspension or removal from the Platform.
5. Fees and Payment
- CharterIndia facilitates payment collection from Customers on your behalf for bookings made through the Platform, and will remit the agreed amount to you, less any applicable CharterIndia service or facilitation fee, as disclosed to you at the time of registration or otherwise communicated in writing.
- Payouts will be made within the timeframe specified on the Platform following successful completion of the flight, subject to any applicable holdback for disputed or unresolved bookings.
- You are responsible for your own tax obligations, including GST registration and remittance, in respect of amounts received through the Platform, except to the extent CharterIndia is required by law to collect and remit tax on your behalf.
6. Insurance and Liability
- You must maintain, at all times, valid third-party liability insurance and passenger liability insurance in amounts sufficient to meet your obligations under applicable law and any applicable international convention (e.g. the Montreal Convention, where relevant), and must provide evidence of such insurance to CharterIndia on request.
- You are solely and fully liable for any death, personal injury, property damage, delay, or other loss arising from or in connection with the carriage performed by you, including during ground handling, boarding, and disembarkation.
- You agree to indemnify and hold harmless CharterIndia, its officers, employees, and affiliates from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of: (a) your breach of these Terms; (b) your operation of any flight; or (c) any inaccurate representation made by you regarding your certification, aircraft, or crew.
7. Cancellation Penalties
- Where you cancel a confirmed booking without a valid reason under Section 4.2, and a suitable substitute cannot be arranged, you may be liable for a cancellation penalty as set out in the Operator fee schedule, intended to compensate CharterIndia for facilitation costs and the Customer for any resulting inconvenience or additional cost.
- CharterIndia reserves the right to withhold future payouts to offset any cancellation penalty owed under this Section.
8. Customer Data and Conduct
- You will receive Customer contact and booking details solely for the purpose of fulfilling a confirmed booking, and must not use such information for unrelated marketing or solicitation purposes, including attempting to redirect a Customer to book directly with you outside the Platform for future travel.
- You must treat Customers professionally and in accordance with applicable consumer protection and aviation safety regulations at all times.
9. Force Majeure
Neither CharterIndia nor the Operator shall be liable for failure to perform obligations under these Terms where such failure arises from circumstances beyond reasonable control, including severe weather, natural disasters, air traffic control restrictions, government action, strikes, or similar events. The Operator remains responsible for promptly notifying affected Customers and CharterIndia of any such event affecting a confirmed booking.
10. Suspension and Termination
- CharterIndia may suspend or terminate your access to the Platform, with or without notice, where you breach these Terms, where your AOC or other required authorisation lapses or is suspended, where you receive repeated and substantiated Customer complaints, or where continued listing poses a reputational or safety risk to the Platform.
- You may terminate your participation on the Platform at any time by written notice to CharterIndia, subject to fulfilling any bookings already confirmed at the time of such notice.
11. Changes to These Terms
CharterIndia may update these Terms from time to time. Continued listing or acceptance of bookings on the Platform after such changes constitutes acceptance of the revised Terms.
12. Governing Law and Jurisdiction
These Terms are governed by the laws of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts at New Delhi.
